Within 10 days of receiving notice of a prospective Candidate’s intention to run, the Human Resources Department must perform a State and United States Federal Background Check. If the Background Check reveals that the prospective Candidate failed to meet the eligibility requirements found in the Cowlitz Indian Tribe’s Constitution, Article V(5)(a)(1)-(5), or By-Laws, then that prospective Candidate must be Disqualified from running for office. Notice must be received by the Tribal Council Chairman and the Election Board. Within three days of receiving the Background Check Report, the Election Board shall send a written notice, specifically outlining the justification for disqualification, by certified U.S. Mail return receipt requested to any disqualified prospective candidate. If the disqualified prospective candidate provided the Election Board with his or her email address, then the notice must also be sent to that email address. [Res. 23-07, 2023; Res. 22-148, 2022.]
