Any individual Disqualified under section 20.06.050 may appeal their Disqualification to the Tribal Council. The Tribal Council’s decision is final. The only valid claim for an appeal is when a prospective Candidate has been disqualified by the Board despite not meeting any of the disqualifying criteria found in Article V Section 5 of the Constitution or Title IV Section 1 of the By-Laws. After receiving notice of Disqualification, the individual has ten (10) Days to initiate an appeal by sending written notice by certified U.S. Mail return receipt requested or e-mail to the Election Board. The ten (1) days will be calculated from the earliest of the sending of an email, or the date of delivery as determined by the U.S. Mail returned receipt. [Res. 22-148, 2022.]
