Employer shall pay all Employees no less than the U.S. Federal Minimum Wage rate for each hour worked unless they are exempt as defined below.

(1) Employees will be paid one and one half times their regular rate of pay when they work over forty hours in a workweek unless they are exempt as defined below. In lieu of overtime pay, Employer may provide compensatory time benefits at the rate of one and one half hours.

(2) An Employee is exempt from this Wage and Hour Code if they would have been exempt from, or not covered by, the U.S. Fair Labor Standards Act (FLSA) if the FLSA were applicable. While the FLSA does not apply, when implementing this Code, Employer may look to the definitions of exempt or not covered employees in the Code of Federal Regulations (CFR) and related opinions issued by the Department of Labor (DOL).
