Chapter 31.37 MISCELLANEOUS RULES

(1) Violation of Rules of Civil Procedure. Failure to comply with the Rules set forth herein may result in revocation of the offending party’s right to participate further in the review process, or other sanctions as deemed appropriate by the Tribal Court, including those provided in the Tribal Court Code.

(2) Damages for Frivolous Action or Appeal. If the Tribal Court determines that a claim or an appeal is frivolous, it may award damages and costs incurred as a result to the defendant or respondent.

(3) Waiver of Rules of Civil Procedure. If such actions serve the ends of justice and will ensure that a fair and just determination of a case on its merits can be made from the record, the Tribal Court may, upon a showing of good cause by either party:

(A) Waive the formal requirements for the content of a pleading, motion, or an appellate brief, provided that the document submitted is legible and understandable; or

(B) Extend the time period for filing a pleading, motion, or appellate brief; or

(C) Modify the procedural requirements of any other section of these Rules. [Res. 24-44, 2024.]
