Chapter 31.09 FEES

(1) Fees. The Tribal Council shall set all fees of the Tribal Court in a Fee Schedule. The Fee Schedule shall be maintained by the Clerk and made available to the public. Tribal Court judges may recommend amendments to the Tribal Council, but the Tribal Council in its sole discretion will determine whether to approve such amendment(s).

(2) Sanctions.

(A) Judges may require observance of the rules described in this Code, and/or any Court procedural rules adopted by the Tribal Council before taking any action in a case; and

(B) Where any party to a case before the Tribal Court suffers actual monetary damages, including fees to a representative, due to delay in the proceedings or any other reason because of the failure of another party in such case to obey these rules, this Code, or any other applicable Tribal law, the injured party may move the Tribal Court to recover their actual monetary damages.
