Chapter 31.08 DECISIONS

(1) Form. The final decision of any Tribal Court proceeding, whether at trial or on appeal, shall be recorded on a form approved by the Clerk for such purpose. The decision form shall provide for recording the date, the case number, the parties, the substance of the complaint, a brief summary of the evidence presented and the judgment of the Tribal Court.

(2) Recording. All final decisions shall be placed in the case file as an official document of the Tribal Court.

(3) Precedential Decisions. The Clerk shall also be responsible for maintaining all precedential decisions of the Tribal Court, and make precedential decisions of the Tribal Court publicly available to any requesting person upon payment of the fee provided in the Tribal Court Fee Schedule and electronically. All precedential decisions shall be maintained indefinitely.

(A) Precedential decisions involving any person under the age of 18 shall be written and maintained in a manner so as to protect the identity of the children involved, including obscuring the names of any parents of such a child, if the disclosure of the parent’s name would cause the disclosure of private information regarding the child.
