Spoiled ballots must not be counted. For purposes of this Code, “spoiled” means any one or more of the following

(1) A ballot that is opened, tampered with, or otherwise affected in a manner that it reasonably appears a party other than the individual submitting the ballot has modified the ballot’s contents; or

(2) The Tribal Member voting number on the ballot or return envelope has been marked or mutilated and the number cannot be ascertained; or

(3) The mailed-in ballot is not returned in the numbered, self-addressed, postage paid, security envelope; or

(4) A ballot which has been mutilated, damaged, or otherwise rendered in a physical condition which prevents it from being used and counted in a way that the intent of the voter will be clear. [Res. 22-148, 2022.]
