Chapter 31.05 COURT CLERK

There shall be a Court Clerk (“Clerk”).

(1) Qualifications of Clerk. The Clerk shall:

(A) Be qualified, within the sole discretion of the Tribal Council, to perform the duties of the Clerk as set forth in this Code; and

(B) Be bondable.

(2) Appointment of Clerk. The Clerk shall be appointed by the Tribal Council.

(3) Duties of the Clerk.

(A) The Clerk shall keep the records of any Tribal Court proceeding (including applicable appeals) including, but not limited to, a case file with an identifying number, containing all of the pleadings and all papers filed in each case;

(B) The Clerk shall post all notices required by Tribal law to be given in relation to any Tribal Court proceeding;

(C) The Clerk shall assist all persons or organizations with their business in any Tribal Court proceeding so as to ensure the efficient operation of such proceeding;

(D) The Clerk shall collect all fees and fines paid, pay out all duly authorized fees, and account for all moneys to the Tribal Council;

(E) During the pendency of any case, the Clerk shall attend all sessions of any Tribal Court to assist the judge in the conduct of such proceeding;

(F) The Clerk shall perform such other duties as such judge may direct in the conduct of such proceeding;

(G) The Clerk shall maintain a list of ordinances and codes that confer subject matter jurisdiction on the Tribal Court;

(H) The Clerk shall maintain a list of attorneys and other representatives that are admitted to appear before the Tribal Court;

(I) The Clerk shall maintain a list of all Tribal Court fees; and

(J) The Clerk shall perform such other duties as may be specified in any other provision of this Code, or Tribal law.

(4) Termination of a Clerk. The Clerk may be removed from office for cause by the vote of a majority of a quorum of the Tribal Council or upon written resignation submitted to and approved by the Tribal Council. [Res. 24-44, 2024.]
