Chapter 31.03 APPLICABLE LAW

(1) In all cases before it, the Tribal Court shall first apply duly enacted Tribal law, and applicable federal law. When appropriate, the Tribal Court shall rely on previous opinions issued by the Tribal Court interpreting Tribal law.

(2) In all civil matters, the Tribal Court shall first adhere to the requirements of subsection (1) of this chapter, and where the aforementioned is not instructive, the Tribal Court may be guided by the law developed by other jurisdictions, including other tribes. Legal principles and standards from other jurisdictions shall be considered as persuasive authority only, and not binding upon the Tribal Court. [Res. 24-44, 2024.]
