(1) For Cause Removal. CEA Board members may be removed for cause by a two-thirds vote of the Tribal Council.

(2) Cause. Cause for removal includes, but is not limited to, negligently or willfully engaging in misconduct in the performance of his or her duties; acting with self-interest to the detriment of the Tribe; engaging in criminal acts; and failure to maintain licenses by federal or Tribal law. Inactivity or inability to serve shall also be considered sufficient cause for removal.

(3) Right of Rebuttal. CEA Board members shall be given an opportunity to provide evidence rebutting the grounds for their proposed removal before the removal is decided. The decision of the Tribal Council shall be final. [Res. 23-139, 2023.]
