(1) Prior to Trial, a defendant may be released from custody by any one or more of the following ways: upon posting bail, upon their own recognizance, or upon conditions set by the Court. Bail must be fixed in an amount by the Court or by the bail schedule regularly used by the Court. The burden of establishing that the defendant will not flee or pose a danger to any other person or to the community rests with the defendant.

(2) A person released before trial shall continue on release during trial on the same terms and conditions as were previously imposed, unless the Court determines that other terms and conditions or termination or release are necessary to assure that their conduct will not obstruct the orderly and expeditious progress of the trial.

(3) A defendant may continue on release if a presentence investigation is ordered by the Court or may be continued on release pending appeal, if a notice of appeal is filed as provided for in this code. The burden of establishing that the defendant will not flee or pose a danger to any other person or to the community rests with the defendant. If a fine only has been imposed and the defendant has filed a notice of appeal, a bond sufficient to cover the payment of the fine, costs of the Court, and cost of appeal must be approved by the judge before release is granted.
