(1) If, by reason of death, sickness, or other disability, the judge before whom a bench trial has commenced is unable to proceed with the trial, a mistrial must be declared. A new trial must commence before any other Judge regularly sitting or assigned to the Court.

(2) If, by reason of death, sickness, or other disability, the judge before whom a jury trial has commenced is unable to proceed with the trial, any other judge regularly sitting or assigned to the Court may proceed and complete the trial. A defendant may move for a new trial due to the disability of the original trial judge. Such a motion will be denied unless the defendant can demonstrate to the Court prejudice sufficient to overcome the cost and time required for a new trial.

(3) If, by reason of absence, death, sickness, or other disability, the judge before whom the defendant has been tried is unable to perform their duties after the verdict or finding of guilt, any other judge regularly sitting may perform such duties and may order a new trial to be held.
