(1) A person commits the offense of sexual assault when he or she knowingly causes another person to have sexual contact with him or her or another without consent or by force, or who commits an assault as defined by Chapter 26.15 CTC, when such assault involves sexual contact.

(2) Sexual assault is a Class E offense.

(3) An act “in the course of committing sexual assault” shall include an attempt to commit the offense or flight after the attempt or commission.
