Article VIII. Crimes and Civil Sanctions

(1) Crime. Any violation of this chapter, including the provision of false or misleading information, by a sex offender shall be considered a crime under CTC Title 26 as it now exists and hereafter amended and subject to a period of incarceration of 365 days in jail and a fine of

$5,000. The Tribes reserves the right to garnish per-capita to satisfy the fine.

(2) Civil Penalty. Each violation of a provision of this chapter by any sex offender shall be considered a civil violation subject to enforcement by any means not prohibited by Federal law, including, but not limited to, the issuance of fine of $5,000, forfeitures, or civil contempt.

(3) Persons failing to register as required under this chapter shall be excluded from the exterior boundaries of the Reservation under the provisions outlined in Chapter 26.22 CTC.
