SECTION 1. Enumerated Powers. The Cowlitz Tribal Council shall possess the following powers delegated by the General Council subject to all applicable laws of the United States and this constitution.

(a) To conduct the business of the Tribe on behalf of the Cowlitz General Council. Act in all matters that may involve the welfare of the Cowlitz Indian Tribe and to make decisions consistent with this constitution and the history and culture of the Cowlitz Indian Tribe.

(b) To purchase, buy and accept any land or other property for the Cowlitz Indian Tribe which the Cowlitz Tribal Council determines to be reasonably beneficial to the Cowlitz Indian Tribe.

(c) To take and accept ownership in trust when the United States Congress or other agencies may so provide.

(d) To negotiate and communicate with Federal, State or local governments on behalf of the Cowlitz Indian Tribe, and to advise and consult with various Federal, State or local agencies involved with the welfare of the Cowlitz Indian Tribe.

(e) To administer any funds or property controlled, held or owned by the Cowlitz Indian Tribe and to make expenditures for purposes including salaries and remuneration of elected officials, officers and tribal employees.

(f) To administer charity.

(g) To manage all economic affairs of the tribe consistent with this constitution and any charter of incorporation.

(h) To charter or authorize tribal corporation, organizations and enterprises for economic purposes and to regulate all the activities of such business entities.

(i) To develop and adopt legislation for the protection of wildlife and resources within the jurisdiction of the Cowlitz Indian Tribe.

(j) To enact legislation regulating the procedures of the Cowlitz Indian Tribe.

(k) To employ or appoint legal counsel for the protection and advancement of the rights of the Cowlitz Indian Tribe and its membership subject to the requirements of federal law.

(l) To approve any sale, disposition, lease or encumbrance of tribal lands, interest in tribal land, or other tribal assets.

(m) To suspend any tribal officer convicted or charged with a felony, criminally injurious conduct, or conduct involving fraud or moral turpitude when approved by a two-thirds (2/3) majority vote of the Tribal Council members present at a regularly scheduled Tribal Council meeting with a quorum.

SECTION 2. Potential Powers. The Cowlitz Tribal Council may exercise such governing powers as may be delegated to it by the General Council of the Cowlitz Indian Tribe.

SECTION 3. Powers Reserved. Any powers not expressly referred to in this constitution are reserved by the Cowlitz Indian Tribe and this constitution shall not abrogate, modify or abridge such reserved powers.
